Terms of Service

Welcome to PNEO. These Terms of Service ("Terms") govern your use of the PNEO mobile application and the website at humanperformancecenter.com (together, the "Services"), operated by [COMPANY LEGAL NAME] ("we," "us," or "our"). By downloading, installing, or using PNEO, you agree to these Terms. If you do not agree, do not use PNEO.
1. Who can use PNEO
You must be at least 13 years old to use PNEO. If you are under 18, you must have a parent or legal guardian's permission.
2. Medical disclaimer
PNEO is not a medical device and is not a substitute for medical advice, diagnosis, or treatment. The breathing protocols and information provided through PNEO are for general wellness and educational purposes only. Always consult a qualified healthcare provider before starting any new breathing practice, especially if you have asthma, chronic obstructive pulmonary disease (COPD), heart conditions, a history of fainting, seizures, high or low blood pressure, panic disorder, pregnancy, or any other medical condition. Stop any practice immediately if you feel dizzy, lightheaded, short of breath, or unwell, and seek medical attention if needed. Your use of PNEO is at your own risk.
3. Your account
To use certain features of PNEO, you may need to create an account. You agree to provide accurate information and keep it up to date. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
4. Subscriptions and billing
PNEO is free to download. Certain features are available only with a paid PNEO Pro subscription.
Billing. All purchases are processed by Apple through the App Store. You agree to Apple's billing terms when you subscribe. Subscriptions will automatically renew at the end of each billing period unless you cancel at least 24 hours before the end of the current period.
Cancellation. You can cancel your subscription at any time in iOS Settings → your name → Subscriptions. Cancellation takes effect at the end of your current billing period; you will continue to have PNEO Pro access until then.
Refunds. Refund requests are handled by Apple under Apple's refund policy. We are not able to issue refunds directly.
Price changes. We may change subscription prices. If we do, we will notify you in advance and give you an opportunity to cancel before the change takes effect.
Free trials. If we offer a free trial, you must cancel before the trial ends to avoid being charged.
5. Acceptable use
You agree not to:
Use PNEO for any unlawful purpose or in violation of these Terms;
Reverse engineer, decompile, or attempt to extract the source code of PNEO;
Copy, modify, distribute, sell, or lease any part of PNEO or the content provided through it;
Interfere with or disrupt the integrity or performance of PNEO;
Attempt to gain unauthorized access to PNEO or its related systems;
Use any automated system to access PNEO other than features we provide for that purpose.
6. Intellectual property
PNEO, including all software, content, trademarks, logos, and design elements, is owned by [COMPANY LEGAL NAME] and its licensors and is protected by copyright, trademark, and other laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use PNEO for your personal, non-commercial use, subject to these Terms.
7. User content
If you submit feedback, suggestions, or other content to us, you grant us a worldwide, royalty-free, perpetual license to use that content to operate and improve PNEO. You represent that you have the right to submit any content you provide.
8. Disclaimers
PNEO IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT PNEO WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT IT WILL MEET YOUR REQUIREMENTS OR EXPECTATIONS.
9. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, [COMPANY LEGAL NAME] AND ITS OFFICERS, EMPLOYEES, AGENTS, AND LICENSORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, ARISING FROM YOUR USE OF PNEO. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM OR RELATING TO PNEO WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM AROSE, OR (B) $100.
10. Indemnification
You agree to indemnify and hold harmless [COMPANY LEGAL NAME] from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from your use of PNEO, your violation of these Terms, or your violation of any rights of another person or entity.
11. Termination
We may suspend or terminate your access to PNEO at any time, with or without notice, if we believe you have violated these Terms. You may stop using PNEO at any time. The sections of these Terms that by their nature should survive termination will survive.
12. Governing law
These Terms are governed by the laws of the State of New Mexico, without regard to its conflict of laws rules. Any dispute arising from or relating to these Terms or PNEO will be resolved in the state or federal courts located in Santa Fe County, New Mexico, and you consent to the jurisdiction of those courts.
13. Changes to these Terms
We may update these Terms from time to time. If we make material changes, we will notify you in-app or by email. Your continued use of PNEO after the changes take effect means you accept the updated Terms.
14. Apple-specific terms
You acknowledge that these Terms are between you and [COMPANY LEGAL NAME], not Apple, and that Apple is not responsible for PNEO or its content. Apple is a third-party beneficiary of these Terms and may enforce them against you. Your use of PNEO must comply with the Apple Media Services Terms and Conditions.
